Article 1: General provisions
This e-commerce webshop offers its customers the possibility to purchase the products from its webshop online. These General Terms and Conditions (“Terms”) apply to every order placed by a visitor to this e-commerce webshop (“Customer”). Additional conditions of the Customer are excluded, unless they have been accepted in advance, in writing and expressly.
Article 2: Price
All prices listed are expressed in euros and, unless otherwise stated, include VAT. If delivery, reservation or administrative costs are charged, this will be stated separately. The price quoted refers exclusively to the articles as literally described. The accompanying photos are for decorative purposes and may contain elements that are not included in the price.
Article 3: Offer
Despite the fact that the online catalogue and the e-commerce webshop are compiled with the greatest possible care, it is still possible that the information provided is incomplete, contains material errors or is not up-to-date. Obvious mistakes or errors in the offer are not binding. The seller is in no way liable in the event of obvious material errors, typographical errors or printing errors. If the Customer has specific questions about e.g. sizes, colour, availability, delivery time or delivery method, we request the Customer to contact our customer service in advance. The offer is always valid while stocks last and can be adjusted or withdrawn at any time. The seller cannot be held liable for the unavailability of a product.
Article 4: Online purchases
The Customer has the choice between bank transfer or credit card as payment methods. The seller is entitled to refuse an order as a result of a serious shortcoming of the Customer with regard to orders in which the Customer is involved.
Article 5: Delivery and execution of the agreement
Any visible damage and/or qualitative deficiency of an article or other deficiency in the delivery must be reported by the Customer without delay. The risk of loss or damage shall pass to the Customer as soon as he (or a third party designated by him, who is not the carrier) has physically taken possession of the goods.
Article 6: Retention of title
The delivered items remain the exclusive property of the seller until full payment has been made by the Customer.
Article 7: Right of withdrawal
The provisions of this article apply only to Customers who purchase items online in their capacity as consumers. The consumer has the right to withdraw from the agreement within a period of 14 calendar days, unless otherwise specified, without giving reasons, given that the right of withdrawal applies to the goods or services ordered by the customer. In order to exercise the right of withdrawal, the Customer must inform the seller in a timely manner of his decision to withdraw from the agreement by means of an unambiguous statement (e.g. in writing by post or e-mail). The Customer must return or hand over the goods immediately after his decision to withdraw from the agreement. The direct costs of returning the goods shall be borne by the Customer unless otherwise agreed. If the returned product has been diminished in value in any way, the right is reserved to hold the Customer liable and claim damages for any decrease in value. Only items that are in their original packaging, together with all accessories, instructions for use and invoice or proof of purchase can be taken back. In the event that the agreement includes the provision of services and if the Customer has requested that the provision of services begin during the withdrawal period, the Customer shall pay an amount that is in proportion to what has already been provided at the time he has informed us that he is withdrawing from the agreement, compared to the full performance of the agreement.”
Article 8: Warranty
Under the law of 21 September 2004 on the protection of consumers in the sale of consumer goods, the consumer has legal rights. This legal guarantee applies from the date of delivery to the first owner. In order to invoke the guarantee, the Customer must be able to present proof of purchase. The (commercial and/or legal) guarantee never applies to defects that arise as a result of accidents, neglect, falls, use of the article contrary to the purpose for which it was designed, failure to comply with the instructions for use or manual, adjustments or modifications to the article, rough handling, poor maintenance, or any other abnormal or incorrect use.
Article 9: Sanctions for non-payment
Without prejudice to the exercise of other rights, in the event of non-payment or late payment, the Customer shall owe interest on the unpaid amount by operation of law and without notice from the date of default. Without prejudice to the foregoing, the right is reserved to take back the articles that have not been (fully) paid for.
Article 10: Privacy policy
The seller reserves the right to collect data from the user for internal use only, both directly by collecting data provided by the user at the time of ordering and indirectly (e.g. by using cookies, which are short data strings on the computer of the user of the site that allow the seller to optimally tailor the content and layout of the site to the user). This data will not be passed on to organisations that are contractually linked to the seller. In accordance with the law of 8 December 1992 on the protection of privacy with regard to personal data, the user has the right at all times to view, change, improve and have this data deleted if they no longer wish to receive information about our activities. For this purpose, they can contact the seller's customer service in writing.
Article 11: Affectation of validity – non-waiver
If any provision of these Terms is declared invalid, illegal or void, this will in no way affect the validity, legality and applicability of the other provisions. Failure at any time by the seller to enforce any of the rights stated in these Terms, or to exercise any right hereunder, will never be considered as a waiver of such provision and will never affect the validity of these rights.
Article 12: Changes to conditions
These Conditions are supplemented by other conditions to which explicit reference is made, and the general sales conditions of the seller. In the event of any conflict, these Conditions shall prevail.
Article 13: Applicable law
Belgian law applies. The courts of the Seller's place of residence have jurisdiction in legal disputes. The Seller can also turn to the ODR platform.
